On the threat from FIFA to expel the Swiss

La FIFA vuelve a las andadas, pero esta vez va a ser sonado. FIFA back at it again, but this time it will be sounded. Tras conocer el Fallo del TAS en contra del Sion, el club suizo que trae a mal vivir a Blatter ya Platini, el Comité Ejecutivo de la FIFA, entidad de nacionalidad precisamente suiza, ha decidido fijar un último plazo que vence el 13 de enero de 2012 para que la Asociación de Fútbol de Suiza ejecute la prohibición de inscripción impuesta al Sion sobre suspensión de determinados jugadores incursos en alineación indebida. Labor talks over, owners to lock out players at midnight

Talks on a new collective bargaining agreement between the NBA and its players broke off on Thursday afternoon, prompting the league to announce that it will lock out the players when the current agreement expires at midnight. The lockout would effectively shutter the league and could end up jeopardizing parts or all of the 2011-12 season.

Competitive balance between national leagues in European football after the Bosman Case

In 1995, the Bosman case opened the labour market for players in European professional football. Ever since then, competitive balance between national leagues in European football has reduced in favour of the Big 5 leagues (England, Spain, Italy, Germany and France) and recently of the oligarchic leagues of Russia and Ukraine. In this article we show that changing structures towards an open labour market in separated national product markets resulted in a decreasing competitive balance in UEFA’s European team competitions. Next to a theoretical argumentation, we provide some empirical evidence and assess future options for the structure of European professional football.

Today, no one is surprised to learn that Turkey is one of the destinations chosen by many football players wanting to develop their professional careers. Dani Gúiza and José María Gutiérrez "Guti" did not hesitate to move to Istanbul to play for Fenerbahçe and Besiktas respectively. Yet, not all of them completed their Ottoman experience with the same level of satisfaction; Vicente del Bosque, who was dismissed by Besiktas, knows this very well; so do Luis Aragones, dismissed by Fenerbache, and Frank Rijaard, sacked after only eight matches by Galatasaray.

CBF anticipates mid-season registration period: some juridical remarks

Recently, with a short statement posted on its website, the Confederação Brasileira de Futbol (CBF) announced the anticipation of its mid-season registration period. Instead of taking place between the 3rd and the 31st of August 2010, as established by the Resolução da Presidencia 02/2005, the (inaccurately) so-called “transfer window” will start on the 20th of July 2010 and end on the 19th of August 2010.

The relationship between sports, law and policy is at a crossroad. Since the entry into force of the Lisbon Treaty on 1 December 2009 sport has become part of EU policy. In anticipation, the White Paper on Sport of 11 July 2007 represented an important step towards a comprehensive European Sport framework. Already before, the European Court of Justice repeatedly stated in its case law that sport is subject to EU law in so far as it constitutes an economic activity within the meaning of the Treaty. Sports associations at every level of organisation have been forced to comply with EU law and athletes have benefited from the rights enshrined in the Treaty.

THE LIABILITY OF THE COACHES IN THE WORLDWIDE FIGHT AGAINST DOPING

The CAS sanctioned the football coach Edward Eranosian with 4 years of ineligibility.


There have been a huge amount of doping cases solved by the Court of Arbitration for Sport, in both ordinary and appeal procedures, since the creation of the World Anti-doping Agency in 1999 (WADA). This time, CAS was called in an appeal procedure to decide about several decisions taken by a football federation regarding doping matters.

Statement on planned referee strike

Stewart Regan, Scottish FA Chief Executive:

“I have every sympathy for the refereeing fraternity at this time and completely understand why incessant scrutiny, criticism and questioning of their integrity has brought them to the brink of a withdrawal of labour. I cannot, however, condone what will amount to strike action and believe we must now engage in positive dialogue to avert the possibility that we will have no football this weekend.
